CASEY CO. MAN CONVICTED ON DRUG CHARGES; JURY RECOMMENDS 15 YEARS

 
On Monday, May 6, 2019 a Casey County Circuit Court jury convicted James H. Shell, age 54, of Marijuana Cultivation - 5 or More Plants. The jury also convicted Shell of being a 1st-Degree Persistent Felony Offender and recommended that he serve 15 years in prison. 
 
According to testimony at trial, Trooper David Long, an aerial spotter with the Kentucky State Police Marijuana Eradication Task Force, discovered marijuana plants growing in an area near Bryant Ridge Road in Casey County in July, 2018. The aircraft landed near the location of the marijuana plants and Long observed James H. Shell operating a chainsaw clearing a tree near several of the plants. KSP Detective Clint Walker, an officer with the Kentucky State Police Cannabis Suppression Unit, responded to that location and conducted further investigation which led to the discovery of 409 marijuana plants and several items of evidence which linked Shell to the marijuana. The plants were confiscated by the KSP Marijuana Eradication Task Force. Testimony at trial revealed that the plants had an estimated street value in excess of $818,000, with the potential to produce over 400 pounds of processed marijuana. 
 
Commonwealth’s Attorney Brian Wright prosecuted the case and presented evidence pertaining to Shell’s cultivation of the marijuana in the first stage of the trial. During the penalty phase of the trial, Wright introduced evidence concerning Shell’s prior criminal record, including certified copies of prior convictions for Assault, Flagrant Nonsupport, and Escape. 
 
After hearing evidence pertaining to Shell’s cultivation of the marijuana and evidence of his prior criminal history, the jury deliberated and returned with their verdict fixing Shell’s punishment at imprisonment for 15 years. Wright commended Det. Walker and the other officers for their efforts in removing such a large quantity of illegal drugs from Casey County. Wright added, “my office will continue to aggressively prosecute those persons who choose to profit from the production and/or sale of illegal drugs in this jurisdiction.” 
 
Formal sentencing for James Shell is scheduled for July 8, 2019, before Casey Circuit Judge Judy Vance Murphy.
